Illinois Appellate Court Overturns Fake Marijuana Conviction

SPRINGFIELD, Ill. (AP) — An Illinois appellate court has overturned the conviction of central Illinois gas station owner authorities say sold synthetic marijuana.

The (Bloomington) Pantagraph reports the 4th District Appellate Court reversed a 2013 conviction of Kuldeep Chatha because of a lack of evidence that he knew the jars he was selling contained banned substances.

Illinois has prohibited the sale of the synthetic drug since 2011. The fake drugs often are labeled as incense or potpourri but are usually smoked for a high similar to marijuana.

The Pantagraph reports the charges were dependent on Chatha knowing the product called Bulldog Potpourri that was sold to a confidential police source by a store clerk in 2012 contained synthetic marijuana. The store owner has claimed he didn’t’ know it was illegal.
