CHICAGO (AP) — A Cook County jury will decide whether a man accused of killing a Chicago police officer is mentally fit for trial.
Marcus Floyd was shot by the father of 30-year-old Officer Thomas Wortham IV, who was killed in a May 2010 shootout with men trying to steal his motorcycle.
Public defender David McMahon contends Floyd suffered “retrograde amnesia” after losing massive amounts of blood and suffering two heart attacks. McMahon says the 24-year-old Floyd “doesn’t know what his defense is.”
Prosecutors say Floyd meets the legal definition of fitness because he can make new memories, speak coherently and logically. If he is found mentally fit by a six-person jury, Floyd would go to trial.
Two men, Paris McGee and Toyious Taylor, have been convicted of Wortham’s murder and sentenced to mandatory life sentences.
