Judge Considers Whether to Dismiss Illinois Head-Injury Suit

CHICAGO (AP) – A judge is considering whether to grant a motion by Illinois’ prep sports body to dismiss a class-action head-injury suit against it. Cook County Judge Leroy Martin Jr. heard oral arguments Friday.

Illinois High School Association attorney Thomas Heiden argued the lawsuit sought new mandates that would threaten high school football. He added that football has taught Illinois kids life lessons since the 1800s and that “they need more of those lessons.”

Plaintiff attorney Joe Siprut countered that the IHSA was trying to “shock and awe” the judge by raising the false specter of the lawsuit killing football. He added the only question relevant to the motion was whether the lawsuit states a plausible enough claim to continue. Siprut says it does.

Martin said he’d rule by mid-August.
